PLEASE READ THIS AGREEMENT CAREFULLY. BY ACCESSING OR USING ILLUSION LABS SERVICES, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO ALL THE TERMS OF THIS AGREEMENT, YOU MAY NOT ACCESS OR USE ILLUSION LABS SERVICES.

These Terms of Use (“Agreement”) is an agreement entered into by Illusion Labs AB, a company registered in Sweden with a registration number 556748-0214 and you (“You”), and governs Your access and use of the Illusion Labs services, such as game software, offered by Illusion Labs and its subsidiaries (“Illusion Labs”, “us”) and related updates, upgrades and features as well as online and mobile services, features, content, customer support and websites offered by Illusion Labs (collectively “Illusion Labs Services”, or “Services”).

These Terms of Use (“Agreement”) include our policy for acceptable use of the Services and govern your rights, obligations and restrictions regarding your use of the Services. You are only authorized to use the Services if you agree to abide by all applicable laws and this Agreement. By using the Services, you agree to be bound by this Agreement.

Because your privacy is important to us, this Agreement also incorporates, by this reference, our Privacy Policy (https://www.iubenda.com/privacy-policy/65726256), which explains how we collect and use your content and information. Please read the Privacy Policy.

Your access and use of the Services constitutes your representation and warranty that you are of legal age to form a binding contract, and if not of legal age, that you access and use the Services with the permission of a parent or legal guardian, and that you are not a person barred from using or receiving the Services by any local, state, federal or international law.

Personal Data

When using Illusion Labs Services, Illusion Labs might collect some personal data, for the purpose of providing the Services, and monitoring the use to improve our Services, and provide personalized content. Information we collect is specified below. We will process the personal data in a manner that reasonably ensures appropriate security against unauthorised or unlawful processing and against accidental loss, destruction or damage. If any of the personal data you provide to us is found to be incorrect, make sure to notify us at info@illusionlabs.se, or the contact details in the Privacy Policy, and we will correct it. Personal data will only be stored for the duration needed to provide the Services to You, and will thereafter be erased, aggregated or anonymised.

You can at any time request for your personal data to be erased by notifying us through the contact details in the Privacy Policy. This might also mean we can no longer provide the Services to You.

Illusion Labs use subprocessors such as Google Cloud Services to provide some of the Services. This might mean some personal data is transferred outside of EES. The subprocessors used and the countries they are located in is specified in the Privacy Policy. Information You Give To Us

We receive and store any information you give to us, such as when you:

• download, update and play our games;
• interact with us via social media such as Facebook, Twitter, YouTube, Instagram;
• contact support;
• purchase our merchandise;
• enter our competitions;
• make an in-app purchase; or
• give us your information in another way.

Information Collected Automatically

We receive and store some information automatically when you interact with us, such as:

• information about how you use our Services, for the purpose of improving the Services.
• stability information, such as crash logs if the Service fails, for the purpose of improving the Services
• information about the device you use to access our Services such as its make & model, operating system version, platform, time zone and IP address;
• your general location (ie. city/country) based on your IP Address;

User Generated Content (“UGC”)

You are responsible for your UGC. You may not upload UGC that infringes a third party’s intellectual property rights or that violates the law, this Agreement or a third party’s rights. Illusion Labs may, at its sole discretion, remove, edit or disable UGC for any reason. Illusion Labs does not pre-screen UGC and does not endorse or approve any UGC available on Illusion Labs Services.

When you contribute UGC, you grant to Illusion Labs, its licensors and licensees a non-exclusive, perpetual, transferable, worldwide, sublicensable license to use, host, store, reproduce, modify, create derivative works, publicly perform, publicly display or otherwise transmit and communicate the UGC, or any portion thereof, in any manner or form and in any medium or forum, whether now known or hereafter devised, without notice, payment or attribution of any kind to you or any third party. You also grant all other users who can access and use your UGC on an Illusion Labs Service the right to use, copy, modify, display, perform, create derivative works from, and otherwise communicate and distribute your UGC on or through the relevant Illusion Labs Service without further notice, attribution or compensation to you.

Virtual Items

Some Services may allow you to “earn” or “purchase” (a) virtual currency, including but not limited to virtual coins, apples, cash, tokens, or points, all for use in the Services; (b) virtual in-game items; or (c) in-game benefits (“Virtual Items”). Virtual Items have no real-world value and cannot be redeemed for real-world currency, goods or other items of monetary value. This includes any unused Virtual Items remaining in your account at the time your account is closed, regardless the cause of the account termination. All sales of Virtual Items are final. No refunds will be given, except at our sole and absolute discretion.

A purchase of any Virtual Item is a purchase of a license to use the Virtual Item in the applicable Services and does not transfer ownership of that Virtual Item to you. This license is personal to you and cannot be sold, transferred, assigned, gifted, traded or sublicensed.

Rules of Conduct

When you access or use an Illusion Labs Service, you agree that you will not:

• Violate any law, rule or regulation.
• Interfere with or disrupt any Illusion Labs Service or any server or network used to support or provide an Illusion Labs Service, including any hacking or cracking into an Illusion Labs Service.
• Use any software or program that damages, interferes with or disrupts an Illusion Labs Service or another’s computer or property, such as denial of service attacks, spamming, hacking, or uploading computer viruses, worms, Trojan horses, cancelbots, spyware, corrupted files and time bombs.
• Interfere with or disrupt another player’s use or enjoyment of an Illusion Labs Service.
• Publish, post, upload or distribute UGC or content that is illegal or that you don’t have permission to freely distribute.
• Publish, post, upload or distribute any content, such as a topic, name, screen name, avatar, UGC, or other material or information, that Illusion Labs (acting reasonably and objectively) determines is inappropriate, abusive, hateful, harassing, profane, defamatory, threatening, hateful, obscene, sexually explicit, infringing, privacy-invasive, vulgar, offensive, indecent or unlawful.
• Post a message for any purpose other than personal communication. Prohibited messages include advertising, spam, chain letters, pyramid schemes and other types of solicitation or commercial activities.
• Impersonate another person or falsely imply that you are an Illusion Labs employee or representative.
• Attempt to obtain a password, account information, or other private information from anyone else on Illusion Labs Services.
• Use any robot, spider or other automated device or process to access Illusion Labs Services for any purpose or copy any material available on the Services.
• Use or distribute unauthorized software programs or tools, such as “auto” software programs, “macro” software programs, “cheat utility” software program or applications, exploits, cheats, or any other game hacking, altering or cheating software or tool.
• Modify any file or any other part of the Illusion Labs Service that Illusion Labs does not specifically authorize you to modify.
• Use exploits, cheats, undocumented features, design errors or problems in an Illusion Labs Service.
• Use or distribute counterfeit software or Illusion Labs Content, including Illusion Labs Virtual Currency.
• Attempt to use an Illusion Labs Service on or through any service that is not controlled or authorized by Illusion Labs.
• Sell, buy, trade or otherwise transfer or offer to transfer your Illusion Labs Account, any personal access to Illusion Labs Services, or any Illusion Labs Content associated with your Illusion Labs Account, including Illusion Labs Virtual Currency and other Entitlements, either within an Illusion Labs Service or on a third party website, or in connection with any out-of-game transaction, unless expressly authorized by Illusion Labs.
• If an Illusion Labs Service requires you to create a “user name” to represent you in game and online, you should not use your real name and may not use a user name that Illusion Labs determines is vulgar or offensive or violates someone else’s rights.
• Engage in any other activity that significantly disturbs the peaceful, fair and respectful gaming environment of an Illusion Labs Service.
• Use information about users publicly available in any Illusion Labs Service (e.g. on a leaderboard) for any purpose unrelated to the Service, including to attempt to identify such users in the real world.
• If you or someone using your Illusion Labs Account violates these rules and fails to remedy this violation after a warning, Illusion Labs may revoke access to certain or all Illusion Labs Services. In case of severe violations, Illusion Labs may take these actions without issuing a prior warning. When practical, Illusion Labs will notify you of the action it will take in response to violations of these rules or breach of this Agreement.

If you encounter another user who is violating any of these rules, please report this activity to Illusion Labs by contacting us at info@illusionlabs.se

Illusion Labs may monitor or record online activity or Content on Illusion Labs Services and may remove any Content from any Illusion Labs Service at our own discretion. Please don’t forget that your UGC is public and will be seen by other users.

Changes to this Agreement

Illusion Labs may update this Agreement from time to time. These updates will be posted on our website at https://illusionlabs.com/touchgrind-x-terms-of-use, and take effect from the day of issue. Please check for updates regularly. If you to not agree to the updates in this Agreement, you may not be able to continue to use the Illusion Labs Service.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY CLAIMS OR LOSSES ARISING DIRECTLY OR INDIRECTLY FROM:

• A FAILURE TO PROVIDE OUR SERVICES, OR ANY PART THEREOF;
• CORRUPTIONS TO OR LOSS OF DATA, ERRORS OR INTERRUPTIONS OCCURRING IN THE COURSE OF USING, OR AS PART OF, ANY OF OUR SERVICES;
• ANY SUSPENSION OR DISCONTINUANCE OF ANY OF OUR SERVICES, OR ANY PART THEREOF; OR
• ANY USE OF OUR SERVICES BY OTHER USERS, INCLUDING ANY USE OF OUR SERVICES BY OTHER USERS WHICH CONTRAVENES THESE TERMS.

Warranty

OUR SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS FOR YOUR USE. YOU UNDERSTAND THAT OUR SERVICES CANNOT BE GUARANTEED TO BE ERROR FREE AND THE EXISTENCE OF ANY ERRORS WILL NOT BE A BREACH OF THESE TERMS.
